Privacy Policy
Draft for legal review, not yet in force.
Who is responsible
Lucimbra LLC, 30 N Gould St, Ste N, Sheridan, WY 82801, US, runs Fatesight (fatesight.com) and is responsible for your personal data. Contact: support@fatesight.com.
[Counsel: appoint and name an EU representative (GDPR Art. 27) and a UK representative.]
What we collect, and why
- Your quiz answers, such as your date, time and place of birth, gender, relationship status, first name and anything you type in your own words: to make your reading and results. (Needed to provide the service.)
- Your partner's date of birth, if you give it for a compatibility report (in the quiz, or in your account before you buy that report): the date alone, never their name, birth time or place. It is information about another person that you chose to give us, used only to write that report, and it stays with your account: it is in your data download and deleted when you delete your account. Please give it only if you believe your partner would be comfortable with it. (Needed to provide the report you asked for.) [Counsel: our basis for data about a third person (GDPR Art. 6(1)(f) and the Art. 14 duty to inform them, with its Art. 14(5)(b) exemption), and whether a date given for a report that wasn't bought should be erased at once rather than kept with the account.]
- Your email address: to send your reading, receipts, the reminders the law requires, and links to your account. (Needed to provide the service.) Marketing emails: in the EU, the UK and Canada only if you say yes, except that as a customer you may get offers about your own membership, such as a lower price after you cancel, unless you said no. In the US you may get them unless you said no. Saying no at the question, or pressing unsubscribe in any of them, stops them all. (Consent; for customers and in the US, our legitimate interest in offering our own service, which you can object to at any time.)
- Your palm photo: it's analysed in your browser and never leaves your device. If you agree, the measurements of your palm lines (not the photo) go to Anthropic, our AI provider in the United States, to write your reading; Anthropic's terms say it deletes them within 30 days. (Consent.)
- Your purchases: what you bought and when, and the amounts and status of your payments, refunds and disputes. Your card number goes to Stripe; we never see it. From Stripe we keep the card's network (for example Visa), last four digits, expiry date and the network's reference for its first payment, so a membership can go on being charged if we ever move to another payment processor. If you pay with PayPal, PayPal keeps your payment details and we get only the payment's reference and amount. (Needed to provide the service; tax and accounting law.)
- Where you are: your country and, in the US, your state, worked out from your IP address when you visit, so we apply local rules (age, cancellation, palm photos). We don't store your IP address. (Legitimate interests; legal obligations.)
- How you found us: if you came from an ad, the campaign, ad set and ad numbers and the click identifier in the link, to see which ads work. (Legitimate interests.)
- Which quiz screens are seen: counted per screen, without the count being tied to you, to improve the quiz. (Legitimate interests.)
- Ad measurement: when you sign up, start a checkout or buy, we tell Meta (Facebook and Instagram), so we can see which of our ads work and Meta can show them to people likely to be interested. Meta gets a scrambled (SHA-256 hashed) copy of your email address and of your customer number, the identifier of the ad you clicked, your browser's type (its user agent), what happened and when, and for a checkout or purchase the amount and currency. Never your answers, birth details, sign, palm or anything you type. We keep your browser's type with your order only until the purchase has been reported. In the US we do this unless you opt out on the privacy choices page or with Global Privacy Control; in the EU, the UK and Canada only if you said yes when we asked. (US: legitimate interests, with your right to opt out; EU, UK and Canada: consent.)
- How you use your account: the days you open your account page and your readings, and how many messages you send the guide (not what they say). If you dispute a payment with your bank or with PayPal, we send them, through Stripe or PayPal, these facts, the terms you agreed to (with their fingerprints) and the dates of the emails we sent you, never your answers, readings or messages. (Legitimate interests: showing a payment was authorised and the service delivered.)
- Your conversation with the AI guide: what you write and its replies, kept with your account so you can read them again. Your messages, your first name and your Sun sign go to Anthropic, our AI provider in the United States, to write each reply. So the guide can pick up where you left off, it also keeps short notes of what you asked about and what you told it about your life: never anything about health, sexuality, religion or politics, and nothing from a conversation in which you mentioned a crisis. You can read every note under the chat, delete any of them, or turn the notes off. If a message mentions suicide, self-harm or an eating disorder, we show helplines instead of an AI reply and count that it happened, without your name or your message; for a while afterwards we make you no offers. (Needed to provide the service; the notes: our legitimate interest in a guide that remembers, which you can switch off.) [Counsel: what a member types may itself be special-category data; confirm the basis, and Anthropic's retention for chat.]
- The morning email, if you turn it on in your account: your choice, when you made it and your time zone (from your browser), so one line of your daily reading arrives in your morning. You can stop it in your account or from any of those emails, at any time. (Consent.)
- The monthly horoscope, if a renewal of your membership brings you one: it is written from your date of birth. The first time you open it we use your browser's time zone to show its dates and times on your own clock, and the name of that time zone is kept with the report. (Needed to provide the service.)
- Messages you send us: to answer you. We keep the text of your emails and our replies; attachments are listed by name but not kept. (Needed to provide the service; legitimate interests.)
[Counsel: confirm the soft opt-in for customers in each EU country and the US opt-out reading.]
We don't put advertising pixels or session recorders on our pages: ad measurement goes from our server to Meta's, as described above.
[Counsel: whether Meta receives these events as our processor or service provider (Meta's Business Tools Terms, "Limited Data Use") or as an independent or joint controller; the lawful basis per region.]
Cookies and storage on your device
- A cookie (named arm_ and the test's name) keeps you in the same version of the quiz for 30 days while we compare versions.
- A cookie (age_block) remembers for a year that a date of birth under 18 was entered, so the quiz stays closed.
- A cookie (ad_opt_out) remembers for a year that this browser opted out of ad measurement on the privacy choices page.
- Your browser's storage keeps your quiz progress until you finish, and the link to your account while the tab is open.
[Counsel: whether the comparison cookie needs consent in EU countries.]
Who we share it with
Only the providers that run Fatesight for us, under contracts that limit what they may do with it:
- Cloudflare: hosting, our database, and receiving the emails you send us.
- Stripe: payments.
- PayPal: payments, when you pay with PayPal.
- Postmark: email.
- Anthropic: AI writing (your messages to the guide; your palm line measurements only if you agreed).
- Meta: ad measurement, as described above, where the law allows it or you agreed. Meta also uses what it receives under its own terms and privacy policy.
We don't sell your personal data. Telling Meta about sign-ups and purchases to measure our ads counts as "sharing" under some US state laws: you can opt out at any time on the privacy choices page, and Global Privacy Control is honoured as an opt-out. We give it to authorities only when the law requires it.
Transfers outside the EU and UK
We and our providers are in the United States. Transfers rely on the EU–US Data Privacy Framework where a provider is certified, or on the European Commission's standard contractual clauses.
[Counsel: confirm the transfer basis for each provider.]
How long we keep it
- Payment and tax records (what you bought and paid, refunds and disputes), the terms you agreed to, and the reminders and receipts we sent: as long as your account exists, and after you delete it as described below.
- Emails you send to support@fatesight.com and our replies: 24 months after the conversation's last message, then deleted automatically.
- Everything else: until you delete your account or ask us to.
[Founders and counsel: set a retention period for accounts nobody deletes (for example 24 months after your last visit or purchase); the engine will then delete automatically.]
Deleting your account
You can delete your account yourself: open your account from the link in any of our emails and press "Delete my account". To make sure it's you, we email you a link to confirm. It works for 72 hours, and nothing is deleted until you press it. Then:
- every membership stops at once and nothing more is charged (deleting doesn't refund what you've already paid);
- we delete your email address, your quiz answers, your partner's date of birth if you gave it, your readings, reports and sketches, your chat with the guide, your emails to support and the ad identifiers from your visit;
- we keep what the law and the card networks require, without your email address: your orders and payments, refunds and disputes, the terms you agreed to (with a fingerprint of their exact wording), the reminders and receipts we sent, the days you used your account, and a record of your request and when we carried it out. In place of your address we keep a scrambled code made from it, so that if your bank or PayPal asks about a payment later, or you write to us again, we can find these records. We delete them, and the code, 10 years after your account was deleted: EU tax law asks sellers like us to keep sales records for 10 years.
If you can't open your account, write to support@fatesight.com from the address you signed up with and we'll send the confirmation link to it.
[Counsel: whether 10 years suits every kept record or only the tax records (card-network dispute evidence is needed for up to about 18 months, consent records in California for 3 years, or 1 year after the contract ends if later); Stripe and PayPal keep their own payment records under their own legal duties.]
Your rights
You can ask to see, correct or delete your data, to restrict or object to how we use it, and to receive it in a portable form. You can download everything we hold about you yourself: open your account and press "Download my data" for a file other services can read. You can withdraw a consent at any time; that doesn't affect what we did before. If you live in the EU or the UK, you can complain to your data protection authority. If you live in a US state with a privacy law (such as California), you can ask to know, delete or correct your data, and opt out of sharing for ads on the privacy choices page or with Global Privacy Control; we don't sell it. For anything else, write to support@fatesight.com: we answer within a month (in California, within 45 days), and we never treat you differently for using your rights.
AI and automated decisions
Our readings, sketches and chat replies are made by AI. We don't take decisions about you that have legal or similarly significant effects by automated means.
Children
Fatesight is for adults. When a date of birth shows someone under 18, the quiz stops and we keep none of their answers.
Security
Connections are encrypted. Your data is stored with Cloudflare, and only people who need it for their work can see it, after signing in, with every change recorded.
Changes
We post changes here and email you about important ones.
